Bridgewood Townhouse II, Boca West: 42 townhouse units under the 1974 approval rules
Bridgewood Townhouse II is 42 townhouse condominium units in five split-level buildings, Nos. 20 to 24, in Boca West's Village of Bridgewood. Its 1974 declaration is barely amended: the association approves every sale and lease within 20 days of the owner's notice, with no recorded lease minimum. The Village of Bridgewood Association assesses each unit too.

Bridgewood Townhouse II carries the middle block of building numbers among the three townhouse condominiums of the Village of Bridgewood, in Boca West, unincorporated Palm Beach County. Arvida declared it on 30 September 1974 at "2000 Bridgewood Drive": 42 townhouse units in five split-level buildings numbered 20 through 24 (Art. IV, OR 2355/126, p. 3). Buildings 20 and 24 hold six units, Building 22 eight, and Buildings 21 and 23 eleven each. Every one of the 42 folios on the Property Appraiser's roll is legally "Bridgewood Townhouse Cond II". The Clerk links only two amendments to this declaration, and we read both. One recorded under another index entry would escape us.
How does the association approve a Bridgewood Townhouse II sale?
Under the 1974 text, unchanged on this point. A sale "except to another Unit owner", a lease, a gift or any other transfer needs approval (Art. XVI.A, OR 2355/126, p. 15). The master's Certificate of Compliance and the Club's approval follow.
- The selling owner notifies the association of the buyer's name and address, with whatever else it "may reasonably require" (Art. XVI.B(1)(a), p. 15).
- The association then has 20 days to approve or disapprove. Its approval is issued in recordable form, handed to the buyer and recorded (Art. XVI.B(2)(a), p. 16).
- If the owner's notice demanded a substitute buyer, a refusal obliges the association to produce one at the contract price, in cash, closing within 30 days. Without that offer, the sale is "deemed to have been approved" (Art. XVI.C(1), p. 17).
Without the demand, a refusal simply stands. A corporate buyer, or a trustee for a beneficial owner, also needs an approved Primary Occupant (Art. XVI.B(3), p. 16). Foreclosing institutional lenders and buyers at public sales are exempt (Art. XVI.E, p. 18). Anything else done without approval "shall be void unless subsequently approved" (Art. XVI.F, p. 18).
What does the Village of Bridgewood charge?
Its own assessments, through its own estoppel or the condominium's. Every unit owner on the Replat of Hamlet "S" Plat No. 1 belongs to the Village of Bridgewood Association (Art. IV § 1, OR 2295/213, p. 2; Exhibit A, p. 7). Its assessments, with 10% interest and collection costs, are "a charge on the land and a continuing lien" (Art. V, pp. 2–3). The 1974 cap of $150 a unit a year may be varied by two-thirds of the Village Board (Art. V § 3, p. 3), so it says nothing about today's figure.
The condominium may collect the Village's assessments with its own (Art. XVIII.F, OR 2355/126, p. 20). We ask which estoppel shows them. The Village lien is subordinate to a first mortgage amortized over ten years or more, but only for assessments that fell due before a foreclosure sale or deed in lieu (Art. V § 9, OR 2295/213, p. 4).
What does a buyer pay at closing?
No capital contribution or transfer fee to this association appears in the declaration. The buyer pays the master's capital contribution, the Club's Joining Fee and the estoppel balances.
The master bills Bridgewood Townhouse II $25,289 for 2026/2027, against $23,089 for 2025/2026 (master's adopted 2026/2027 budget, not recorded). On top come the master's per-unit charges. A grantee in a voluntary sale shares liability, jointly and severally, with the grantor for unpaid assessments (Art. XVIII.M, p. 21), and § 718.116 now says so too.
When can a Bridgewood Townhouse II owner lease?
Once the association approves the lease, and only the entire unit (Art. XV.E, OR 2355/126, p. 14). The lease must say it is subject to approval, and the association has 20 days to act. Nothing recorded for Bridgewood Townhouse II sets a minimum term or a yearly cap. The master's rules still apply: nothing in the first 12 months of ownership and nothing under four months.
If the owners later add limits, a condominium amendment banning rentals, changing the rental term or limiting how often owners may rent binds only owners who consent to it and those who take title after it (§ 718.110(13)). We search forward for one on every file.
Where does a Bridgewood Townhouse II title need care?
- Since 24 September 2008 a ground-floor owner may, with a Board majority's approval, cut a hinged gate into the patio privacy fence and park one electric golf cart there (Art. XX, OR 22872/1873, pp. 2–3). Townhouse II adopted this a year before Townhouse I.
- A lender that is not an "Institutional Lender" needs the association's approval, which "may be arbitrarily withheld" (Art. XVI.D, p. 17). This matters for private or seller financing.
- The declaration's lien takes effect when a claim of lien is recorded (Art. XVIII.K, p. 21). Since 2016 the current Condominium Act governs it (OR 28201/27), so the estoppel, not the lien search, is what protects the buyer.
- Fla. Stat. § 553.899 requires milestone inspections only for buildings of three or more habitable stories. A split-level building of two and three stories sits on that line, so we ask what the association's engineer has concluded.
Our practice
How Bayit Title handles this
Because Bridgewood Townhouse II has no recorded lease limits of its own, we check a tenant-occupied unit against the master's rules and the association's lease certificate. We also run the forward search for any leasing amendment recorded since 2016, because one recorded before closing would bind our buyer. If the buyer is financing privately, we raise the lender-approval clause before the contract is final.
