The short answer
Florida taxes a deed at 70¢ per $100 of consideration, or part of $100 in 66 of its 67 counties. Miami-Dade is the exception: 60¢ per $100 of consideration, or part of $100, plus a surtax of 45¢ per $100 of consideration, or part of $100 unless the property is a single-family residence. A mortgage carries 35¢ per $100 of the amount secured, or part of $100 and an intangible tax of 2 mills on each dollar secured — $2 per $1,000. On a $500,000 sale the deed stamps are $3,500. Which side pays is decided by the purchase contract.

The tax is charged on each part of $100, so it rounds up: a $500,050 sale is taxed on 5,001 hundreds, not 5,000.5. The Department of Revenue publishes its own guidance on the documentary stamp tax, which is where the statute’s description of Miami-Dade is confirmed.

Charged here on the whole new loan. Under § 201.09, a note that only renews an existing note, signed by the same borrower and not enlarging it, is not taxed, and nor is the mortgage securing it; a renewal that increases the unpaid balance is taxed only on the increase.

On a mortgage, 35¢ per $100 of the amount secured, or part of $100. On a $500,000 sale that is $3,500 on the deed, and a $400,000 mortgage adds $1,400.
Who pays the documentary stamp tax on the deed in Florida?
The statute taxes the deed; it does not say who pays. The purchase contract allocates it, and the standard Florida contract forms do so in a specific paragraph. Read yours rather than assuming.
