The Enclave, Woodfield: a six-month working capital payment and one lease in 24 months
The Enclave is 42 homes in Woodfield Country Club, built from 1996 to 2000. Its 1995 declaration sets no approval of buyers, but since 22 March 2022 the master declaration requires The Enclave, then the master, to approve every sale. Since 2020 each buyer pays working capital of six months' assessments, or an amount the Board sets. A home may be leased once in 24 months, for at least six months, with the Board's approval.

How The Enclave compares: HOA fees at closing, association by association
The Enclave is a Neighborhood of 42 single-family homes in Woodfield Country Club, built from 1996 to 2000. Legal descriptions read "The Enclave at Woodfield Country Club", Plat Book 76, Page 63, and a lot number (OR 34655/778). The Property Appraiser gives every one of the 42 lots a site address on Enclave Way (Lot 1 is 6498 Enclave Way); deeds have given addresses on "N.W. 38th Way" and "Enclave". Parcels E, F and G are the association's road and open space. Woodfield Partners Ltd., L.P. recorded the declaration on 5 December 1995 (OR 9027/1640), subject to the master declaration at OR 5037/1571 (p. 1). The association's 2024 preservation notice lists it and its amendments (OR 35251/1452). This page rests on those instruments.
Does The Enclave approve buyers?
Yes, and then the master does. The Enclave's own declaration and amendments set no sale approval and no right of first refusal. Since 22 March 2022, though, the master declaration has required that every sale, transfer or conveyance of a Woodfield lot, including a gift, devise or inheritance, be approved by the Neighborhood association within 30 days and then sent to the master for final approval, with a fee of at least $100 (Art. X § 19, OR 33401/264, pp. 29–30). That binds The Enclave whatever its own documents say. The master's approval and Certificate of Compliance and Club membership are required as well.
What does a buyer in The Enclave pay at closing?
Since 2020, working capital of "six (6) months of the annual Assessment, or such other amount as determined by the Board of Directors from time to time ... regardless of whether such conveyance is an original purchase or a resale" (Art. X § 10, OR 31443/1489, p. 2). It is "collectible as an assessment", with the power to file a claim of lien. The figure was two months in 1995 (OR 9027/1640, p. 19) and three months from 2019 (OR 30422/541). The buyer also owes the master's working capital contribution.
Can a home in The Enclave be leased?
Yes, with approval. Since 2000: "No Lot may be leased or rented without the prior written approval of the Board ... provided, however, that no Lot shall be leased more than one (1) time in any twenty-four (24) month period, and each lease of an Improved Lot shall be for a term or not less than six (6) months" (Art. XI § 16, OR 11847/953, p. 4). The Board approves or disapproves within 30 days, and otherwise "the lease shall be deemed to have been approved." The fee is "not to exceed One Hundred ($100.00) Dollars".
These rules were recorded in 2000, before the 1 July 2021 cutoff in Fla. Stat. § 720.306(1)(h), so they bind every owner. The master's leasing rules apply on top.
How do the lien and amendments work?
The lien for assessments follows the form of the other Woodfield Partners declarations: it takes effect when a claim of lien is recorded, and it is subordinate to an institutional first mortgage (Art. X §§ 12–13, OR 9027/1640, p. 20). Since 2000 the declaration is amended by "a majority of the members" (OR 11847/953, p. 5), down from three-quarters with the master's consent (Art. XII § 2, OR 9027/1640, p. 24).
Where does a title in The Enclave need care?
- The 1998 withdrawal. The First Amendment, made by the master association in October 1998 and recorded in 1999, removed Parcels A and I of the plat, land "inadvertently made subject to the Declaration" (OR 11061/1256, pp. 1, 5). It changed no rule.
- Old legal descriptions. A 2003 foreclosure certificate of title described a lot by a mortgage's book and page rather than the plat (OR 15297/1513). We check older legal descriptions in the chain against the plat.
- The old right of first refusal. The Enclave is in the land the master's Third Supplemental Declaration added in 1994 (OR 8145/1577), which gave the developer a right of first refusal on a lot without a house. The 2010 restated master declaration struck it (OR 23721/1800, pp. 39–40), so it no longer applies.
Our practice
How Bayit Title handles this
We take the working capital figure from the estoppel, because the Board may set its own amount. We tell an investor buyer that a home may be leased only once in 24 months. We order The Enclave's and the master's estoppels and the Club's statement together.
