Waters Reach, Boca West: 54 townhouses, and Phase III roads still in the developer's name

Waters Reach is 54 townhouses in three phases off Waters Reach Lane in Boca West, built from 1982 to 1984. The plats dedicate the roads and open space to the association, but the Property Appraiser still lists three Phase III tracts, including Waters Curve Way, under two developer companies. No Village declaration was found in the record.

Waters Reach is 54 townhouses in Boca West, in unincorporated Palm Beach County, built by National Building Enterprises Corp in three phases. The first sale closed in December 1982 and the last buildings went up in 1984. The developer's deeds convey subject to "easements, restrictions, reservations and limitations of record" and name no Village declaration (OR 3851/1136; OR 4558/107). We found none. The risk that the record does show is in who holds title to the common tracts.

What does a Waters Reach sale need?

At least the master's Certificate of Compliance and the Country Club's approval of the buyer. Whether the Waters Reach association must approve the buyer, we could not tell. The recent deeds we read carry no certificate, but none was a sale to an outside buyer. We ask the association for its documents on each file, and record any approval it issues with the deed.

Who holds title to the Waters Reach roads?

Each plat gives its tracts to the association. The Phase III plat says "all of the foregoing parcels, roadways and access tracts are hereby dedicated to the WATERS REACH AT BOCA WEST HOMEOWNERS ASSOCIATION, INC." (PB 46/196). The Property Appraiser's roll tells a different story for three Phase III folios:

  • the drainage Parcels A and H, under National Bldg & Dev Corp;
  • the private road access tracts known as Waters Curve Way and Waters Bend Trail, also under National Bldg & Dev Corp;
  • open-space Parcel E, under National Bldg Enterprises Corp, mailed to Mahogany's address.

The same gap arose once before. In 1998 the developer quit-claimed Phase II's recreation Parcel F and Parcel G to the association, 15 years after their plat (OR 10518/240). No such deed was found for Phase III. The dedication should already vest the tracts, and the roll may simply lag. Still, for a Phase III lot (Lots 801–1204), we look at the road's record owner and confirm the access with the underwriter.

What does a Waters Reach buyer pay?

The master's capital contribution, the Club's Joining Fee and the Waters Reach estoppel's figures. The master bills Waters Reach $134,237 for 2026/2027, up 6.20% (master's adopted 2026/2027 budget, not recorded). That is in addition to its per-unit charges.

A rental amendment to a homeowners' association's documents enacted after 1 July 2021 generally binds only owners who take title after it, or who consent to it (Fla. Stat. § 720.306(1)(h)). Any leasing rule Waters Reach hands us is checked against its adoption date. The master's limits apply to all owners.

Where else does a Waters Reach title need care?

  • A 1998 replat redrew Lot 601 and Parcel G as Lot 601A and Tract G-1, reserving the tract to the association, which accepted it (PB 84/1). We insure that lot by the replat, not by the Phase II plat.

Our practice

How Bayit Title handles this

For a Phase III lot we search the road and open-space folios as well as the lot, and ask underwriting about insured access. We ask Mahogany for the Waters Reach governing documents and any approval form at the start. If the association holds a deed to the Phase III tracts that we have not seen, we ask for its recording information.

Common questions

Does Waters Reach approve buyers?

We could not confirm it from the record. No Waters Reach declaration was found, and the recent deeds we read, none of them a sale to an outside buyer, have no certificate. We ask the association for its documents on each file.

Who owns the roads at Waters Reach?

The Waters Reach association, by plat dedication. But the Property Appraiser still lists Phase III's Waters Curve Way tracts and two other parcels under developer companies (PB 46/196).

Is there a recreation area at Waters Reach?

Yes. Phase II's Parcel F is for recreational facilities. The developer quit-claimed it to the Waters Reach association in 1998 (PB 45/179; OR 10518/240).

How many estoppels does a Waters Reach sale need?

Two association estoppels, Waters Reach's and the master's, plus the Country Club's statement. We found no umbrella association over Waters Reach.
