Island Court, Boca West: 40 townhouse lots whose declaration the builder's deeds name without a book and page

Island Court is 40 fee-simple townhouse lots on Island Court Drive in Boca West, platted in 1987, with a property owners' association that owns the private road. The builder's deeds make each lot subject to a Declaration of Restrictions and Protective Covenants for Island Court but give no book and page, and we have not found it.

Island Court is a 1987 townhouse Village of 40 one-story homes on its own private loop, Island Court Drive, in Boca West, unincorporated Palm Beach County. A homebuilder's two partnerships platted it as "A Part Of Boca West Planned Unit Development" and the Property Appraiser shows its first sales from September 1987 to May 1988. Each home sits on its own lot, so this is not a condominium. Its lot numbers run in groups (11–13, 21–25 and so on to 81–85), which suggests eight buildings. We read the plat, the tract deed and four lot deeds; the Village's own declaration is missing from that record.

What governs an Island Court lot?

The builder's deeds make each lot subject to a "Declaration of Restrictions and Protective Covenants for Island Court". They do not say where it is recorded (for example, Lot 85, OR 5650/1627, recorded 28 April 1988). The same deeds cite the Boca West maintenance covenants by book and page: OR 2057/112, amended at OR 2295/192, OR 2960/289 and OR 3624/1252. Resale deeds of 1992 and 1997 cite no declaration at all (OR 7268/1517; OR 9968/78).

The Clerk's index links no instrument to the plat, and its name search could not be run for this page. So we have not found the declaration or any amendment. Until we do, we cannot say whether the association approves sales or leases, charges a transfer fee, or how it splits roofs, walls and insurance between owners. We get the recorded declaration, with its book and page, from the association on every file and read it before closing.

No umbrella association sits between Island Court and the master. The deeds name only the Island Court declaration and the master's covenants.

What does the plat show?

The plat, recorded on 26 March 1987 (PB 56/67), dedicates three tracts to the Island Court at Boca West Property Owners Association:

  • Tract A, the private road, which is "the perpetual maintenance obligation of said Association … without recourse to Palm Beach County";
  • Tract B, for ingress, egress, utilities and drainage;
  • Tract C, open space.

The drainage easements go to the association as well, with the County free but not obliged to maintain them. The water-management tracts ("L") go to Boca West Maintenance Association, which joined the plat to accept them. The builder quit-claimed Tracts A, B and C to the association by a deed signed on 6 December and recorded on 9 December 1988 (OR 5898/808).

What does an Island Court buyer pay?

Whatever the association's estoppel shows, and the master's capital contribution and the Club's Joining Fee. The master bills Island Court $161,301 for 2026/2027, up 2.26% (master's adopted 2026/2027 budget, not recorded). The master's per-unit charges come on top.

Leasing follows the master's rules at least: no lease in the first 12 months of ownership and none under four months. Whether Island Court adds its own we can say only once the declaration is read.

Our practice

How Bayit Title handles this

We ask Mahogany Services at the start for the recorded Island Court declaration, its amendments and any approval form. We read them before the estoppel comes back, because an approval requirement or transfer fee would change the closing. The lot's access is over Tract A, so we confirm the plat dedication covers it. We search the lot and both owners for association liens, and for any instrument recorded since the latest deed in the chain.

Common questions

Does Island Court approve buyers?

We cannot say from the record. The Island Court declaration the deeds cite has not been found, so we get it from the association and read it on every file.

Is Island Court a condominium?

No. Island Court homes are townhouses on platted, fee-simple lots (PB 56/67), under a property owners' association.

Who owns the road at Island Court?

The Island Court association. The plat dedicates Tract A to it for private road purposes, to maintain without recourse to Palm Beach County, and the builder quit-claimed it in 1988 (OR 5898/808).

How many estoppels does an Island Court sale need?

Two association estoppels, Island Court's and the Boca West master's, plus the Country Club's statement. No umbrella association applies.
