Fairway Oaks, Boca West: 34 townhomes whose two declarations are cited but not located
Fairway Oaks is 34 townhomes on Melbourne Lane, Northcote Drive and Fairfax Drive in Boca West, platted in 1980. Its association owns those streets, while Fairway Oaks Drive belongs to the master. Developer deeds cite two declarations by date only, so the Village's approval and leasing rules come from the documents we obtain on the file.

Fairway Oaks is 34 townhomes in Boca West, in unincorporated Palm Beach County, platted by Yusem Homes in 1980 (PB 40/141). The lots are numbered by building, 11 to 14 through 91 to 94. It is not Fairway Point, the condominium buildings at the end of Fairway Oaks Drive. Nor is it a condominium. We could read the plat, the developer's deeds and two later resale deeds; the declarations themselves were not found.
What the plat and deeds show
- Interior streets. Fairfax Drive, Northcote Drive and Melbourne Lane, Tracts A and B, are dedicated to Fairway Oaks at Boca West Property Owners' Association, Inc. They are "common open space areas for the purposes of landscaping, parking and access", and are "the perpetual maintenance obligation of said corporation" (PB 40/141, dedication ¶ 1).
- The entry road. Fairway Oaks Drive, Tract C, is dedicated to the Boca West Maintenance Association, now the master, "for private road purposes", and as a drainage and utility easement (¶¶ 2–3). The Property Appraiser lists the master as owner of Tract C.
- Two declarations. A 1981 Yusem deed is subject to a "Declaration of Restrictions and Protective Covenants dated January 4, 1980" and one "for Fairway Oaks Townhomes dated February 17, 1981" (OR 3481/6). Neither citation gives a book and page.
What a Fairway Oaks sale needs
A Fairway Oaks resale needs, as a minimum, the master's Certificate of Compliance and the Country Club's approval of the buyer. Two resale deeds we read, from 2010 and 2020, recorded the master's certificate, which names the Village as "Fairway Oaks Homeowners Association, Inc." (OR 31809/1783, p. 3). Neither deed carries a Village approval. That does not show the declarations require none, so we read them before closing.
A Fairway Oaks buyer owes the master's capital contribution and the Club's Joining Fee, and any Village charge we find in the declarations. The master bills Fairway Oaks $99,271 for 2026/2027 (master's adopted 2026/2027 budget, not recorded), on top of the master's per-unit charges. Any Village leasing limits sit with the master's.
Where does a Fairway Oaks title need care?
- The association's name differs between the plat ("Property Owners' Association") and the master's certificate and roll ("Homeowners Association"). We confirm which is the corporation today and use it on the estoppel.
- Without the declarations, we cannot say from the record how the Village's lien ranks or what a buyer owes for a seller's arrears. The master's joint-liability rule applies regardless.
- The streets in front of the homes are association property, not County roads.
Our practice
How Bayit Title handles this
For Fairway Oaks we ask the association for both Yusem declarations and every amendment as soon as the contract is signed. We read them for an approval requirement before the closing date is set, since recent deeds would not reveal one. The estoppel goes to the corporation the Secretary of State shows, in care of the manager it confirms.
