Cypress Walk, Boca West: 43 townhomes on a private road, with an unlocated declaration
Cypress Walk is 43 townhomes on Woodbridge Drive in Boca West, platted in 1983. The association owns the private road and common tracts, and its Certificate of Approval of the buyer is recorded with resales. The declaration for Cypress Walk Townhomes is cited in deeds without a book and page, so we read it on the file.

Cypress Walk is 43 townhomes in Boca West, in unincorporated Palm Beach County. Yusem Homes platted them in 1983 as "A Part of Hamlet V, Boca West – P.U.D." (PB 46/115). The lots are numbered by building: 11 to 14, 21 to 24, and so on to 114. They are not a condominium and are not on DBPR's list. The record we could read is the plat, the developer's deeds, the association's tract deed and recent resale deeds.
What the plat and deeds show
- The road is private. The plat dedicates Tract A, Woodbridge Drive, to the association "for purposes of a private road and other lawful purposes", as its perpetual maintenance obligation (PB 46/115, dedication ¶ 1). Tracts B, E and F, a drainage easement and the water management and recreation tract are dedicated to it too.
- The association holds them. Yusem Homes quit-claimed those tracts to the association in October 1985 (OR 4678/383). The Property Appraiser shows it as their owner.
- The two 1984 Yusem deeds we read name three declarations. Each lot conveyed is subject to the Declaration of Restrictions and Protective Covenants for Cypress Walk Townhomes, the master declaration, and the Village of Cypress Point declaration (OR 4138/179; OR 4179/439). The Townhomes declaration is cited without a book and page.
What a Cypress Walk sale needs
Buyer approval is in use. Certificates of Approval are recorded with recent resales. The association's recorded Certificate of Approval approves the buyers "as the Purchaser", "pursuant to the provisions of the Declaration". It is issued in the name "Cypress Walk Homeowners Association, Inc.", while the plat and the master's certificate name the Property Owners' Association. We ask for the certificate in the plat's name.
Recent resale deeds also carry the master's Certificate of Compliance, and the Country Club must approve the buyer. Entry charges at Cypress Walk are the master's capital contribution and the Club's Joining Fee, plus any Village charge the declaration sets. The master bills Cypress Walk $165,850 for 2026/2027 (master's adopted 2026/2027 budget, not recorded), on top of the master's per-unit charges.
The approval deadline, fee, grounds, leasing limits and any transfer charge are all in the Townhomes declaration. We have not located it, so we read it, and any amendments, on every file. Whatever the Townhomes declaration says, the master's leasing rules bind every Cypress Walk owner.
Is Cypress Walk under the Village of Cypress Point declaration?
Yusem's 1984 deeds say so, and a 1987 resale deed repeats it (OR 4138/179; OR 4179/439; OR 5234/591). They list the Village of Cypress Point declaration, recorded 14 May 1980 at OR 3290/1517, as an encumbrance on the lot. That declaration, by Arvida, creates an association with its own assessments at a uniform rate per unit and a lien that arises without recording (Art. V, OR 3290/1517, pp. 3–6).
We have not traced its Schedule A land against the Cypress Walk plat. The umbrella association is not on the master's roll, and we found no parcel it owns. Later resale deeds mention only restrictions "of record". Whether it still exists or assesses is open, so we ask the manager in writing and order its estoppel if it does.
Our practice
How Bayit Title handles this
For Cypress Walk we first get the Townhomes declaration and its amendments from the association, since the deeds give no book and page. We order the association's approval in its plat name, and ask in writing whether a Village of Cypress Point assessment is billed. Our search runs the association's tracts too, because the private road is its maintenance obligation.
Common questions
Does Cypress Walk approve buyers?
It does in practice. Recent Cypress Walk resales carry the association's recorded Certificate of Approval of the purchasers. The terms are in the Townhomes declaration, which we read on the file.
Who maintains Woodbridge Drive in Cypress Walk?
The Cypress Walk association. The plat dedicates Woodbridge Drive, Tract A, to it as a private road and its perpetual maintenance obligation (PB 46/115).
Is Cypress Walk part of Cypress Point?
The developer's deeds subject Cypress Walk lots to the 1980 Village of Cypress Point declaration (OR 3290/1517). Whether its association still assesses is open; Cypress Walk has its own association.
Is Cypress Walk a condominium?
No. Cypress Walk is 43 platted townhome lots owned in fee simple, under a property owners' association, and is not on DBPR's condominium list (PB 46/115).
