Chapel Creek, Boca West: 37 homes whose declaration we have not found of record

Chapel Creek is 37 single-family homes on Chapel Creek Drive in Boca West, platted in 1984. The plat gives the private road and common tracts to a property owners association. The developer's deeds cite a Declaration of Restrictions and Protective Covenants for Chapel Creek without a book and page, and we have not found it recorded.

Chapel Creek is a street of 37 single-family homes on Chapel Creek Drive in Boca West, in unincorporated Palm Beach County. Yusem Homes–Chapel Creek platted it as Parcel G4 of the Boca West P.U.D., and the plat was recorded on 22 February 1984. Legal descriptions read "Chapel Creek" or "Chapel Creek at Boca West", Plat Book 47, Page 92, with a lot number. The Village's own declaration is the gap in the record, so this page is short.

What does the record show for Chapel Creek?

  • The plat. It dedicates Tract A, the private road, Tract B, landscaping, and Tract C, an access, utility and drainage tract, to "Chapel Creek at Boca West Property Owners Association, Inc." (PB 47/92). Each is the "perpetual maintenance obligation" of that association, "without recourse to Palm Beach County". The waterway easements go to the association too.
  • A correction. A 1985 surveyor's affidavit says the dedication's point of commencement should read the "most northwesterly", not "most northeasterly", corner of Golfside Drive (OR 4590/1010).
  • The deeds. The developer's 1984 deeds convey subject to a "Declaration of Restrictions and Protective Covenants for Chapel Creek" (for example, Lot 1, OR 4299/69). They give book and page for the master's declaration, but none for this one.
  • The master. The master's recorded Certificates of Compliance name the Village association "Chapel Creek Property Owners Assoc., Inc." (OR 17588/71, 2004).

We have not found the Chapel Creek declaration in the deeds, the plat or the index pages we searched. It may have been recorded later than the first sales, or under a name we have not tried. Until we read it, we cannot say whether Chapel Creek approves sales or leases, or charges a transfer contribution. We cannot describe its lien either.

What does a Chapel Creek closing need?

The master's Certificate of Compliance, recorded with the deed, and the Country Club's approval of the buyer. Whatever Chapel Creek's own documents say, the buyer owes the master's capital contribution and the Club's Joining Fee. We also order Chapel Creek's estoppel, which states what the Village association bills. The master's leasing rules apply to every home whatever the Village documents say.

Our practice

How Bayit Title handles this

On a Chapel Creek file we ask the manager for the recorded declaration and every amendment, with their book and page, before we issue the commitment. We run a name search on the developer and the association to find them ourselves. Whatever the declaration says about approval, contributions or leasing goes into the closing instructions once we have read it.

Common questions

Does Chapel Creek approve buyers?

We cannot say from the record. The Chapel Creek declaration the developer's deeds cite has not been found, so we read the association's documents on each file. The master and the Country Club approve in every case.

Who owns the road in Chapel Creek?

The Chapel Creek property owners association. The 1984 plat dedicates Tract A, the private road, to it as its perpetual maintenance obligation (PB 47/92).

How many estoppels does a Chapel Creek sale need?

Two association estoppels, Chapel Creek's and the Boca West master's, plus the Country Club's account statement.

Can I rent out my Chapel Creek home?

The master's rules bar any Boca West lease in the first 12 months of ownership and any lease under four months. Chapel Creek's own leasing terms depend on its declaration, which we read on the file.
